BY PARTICIPATING IN THIS CONTEST, YOU AGREE TO ABIDE BY THESE OFFICIAL RULES:
PROMOTION DESCRIPTION: The Virtual Breeders’ Cup Classic (the “Contest”) begins on October 21, 2015 at 12:00 p.m. EDT and ends on November 10, 2015 at 12:00 p.m. EST (the “Promotion Period”). Entry in the Contest does not constitute entry into any other promotion or Contest. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Spina Technology USA, LLC, PO Box 30278, Bethesda MD 20824 (“Sponsor”), which shall be final and binding in all respects. Sponsor’s computer is the official device for the Contest. The trademarks BREEDERS’ CUP, BREEDERS’ CUP WORLD CHAMPIONSHIPS and related trademarks, service marks, designs and logos are used under license from Breeders’ Cup Limited (“BCL”) and shall at all times remain the property of BCL. Sponsor is the sole decision maker and operator of the Contest, and all inquiries shall be referred to Sponsor.
ELIGIBILITY: Only legal U.S. residents who are eighteen (18) years of age or older are eligible to win the “Grand Prize.” Any registered Facebook customer who has downloaded the “Blazing Silks” application may enter the contest. Sponsor and BCL, and their respective parents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (collectively, the “Promotion Entities”) and their immediate family members, and/or those living in the same household of each, are ineligible to enter the Contest or win a prize.
HOW TO ENTER: During the Promotion Period, you can enter the Contest through the “Contest” tab on the “Blazing Silks – Breeders’ Cup Edition” application on Facebook found here: http://apps.facebook.com/blazing_silks (the “Blazing Silks Facebook App Page”). To enter, follow the links and instructions to complete and submit the registration form and you will receive one (1) entry into the Contest. Limit: Each participant may enter one (1) time during the Promotion Period. Multiple entrants are not permitted, including the use of multiple/different email addresses or sharing of the same email address. Any attempt by any entrant to obtain more than one (1) entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.
Sponsor may share personal information collected in connection with this Contest with BCL, who will use it in accordance with the privacy policy found on BCL’s website at http://www.breederscup.com/privacy-policy. Otherwise, except as contemplated in these Official Rules, personal information collected in connection with this Contest will be used in accordance with the privacy policy found on the iRace Social website at http://iracesocial.com/privacy-policy/.
NOTE: Internet entry must be made by the entrant on the “Blazing Silks – Breeders’ Cup Edition” application on Facebook. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including but not limited to commercial Contest subscription notification and/or entering service sites, will be declared invalid and disqualified for this Contest. The use of any device to automate the entry process is prohibited.
Spina Technology with use the BLAZING SILKS Facebook App Page’s database and simulation engine as the official decision maker for online entries in this Contest. In the event of a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. The Promotion Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error, which may occur in the processing of the entries in the Contest. The Promotion Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries. Limit one (1) entry per person and/or per e- mail address.
WINNER SELECTION AND NOTIFICATION: Throughout the Promotion Period, participating players will have the opportunity to score points, or “Career Earnings”, in the Contest. At the end of the Promotion Period, participating players will attempt to qualify for The Virtual Breeders’ Cup Classic, based on their “Career Earnings”. The Virtual Breeders’ Cup Classic will be held on November 13, 2015, and consist of fourteen (14) horses, in which ten (10) of the horses will be selected based on their performance during the Promotion Period with the final four (4) spots determined by random drawing of all participating players. The results of The Virtual Breeders’ Cup Classic will determine the grand prize and subsequent prizewinners. Any ties in Career Earnings earned during the Promotion Period that result in more than the number of players qualifying for The Virtual Breeders’ Cup Classic will cause there to be held a random drawing to determine the actual number of participants in The Virtual Breeders’ Cup Classic. The potential prizewinners will be notified by telephone and/or mail and/or e-mail, using contact information provided or collected at the time of entry. The Promotion Entities shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. Sponsor, in its sole discretion, will attempt to contact up to one hundred (100) potential winners of a prize in accordance with the above procedure, after which the prize in question may go un-awarded if it remains unclaimed. If any potential prizewinner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prizewinner will be disqualified and an alternate prizewinner may be selected.
PRIZES/APPROXIMATE RETAIL VALUE: The order of finish of the fourteen (14) horses in The Virtual Breeders’ Cup Classic, followed (if necessary) by the amount of the “Career Earnings” earned during the Promotion Period for the remaining horses, will decide the prizes in the following order:

- Entry into the championship race of the Virtual Breeders’ Cup Classic in “Blazing Silks – Breeders’ Cup Edition” “Blazing Silks – High Stakes Racing” where they will have the opportunity to win a VIP trip to the 2016 Breeders’ Cup, including travel to/from Pasadena, CA, one (1) hotel room for three (3) nights, two (2) tickets to Breeders’ Cup Friday and Saturday at Santa Anita and one (1) $100 wagering voucher.

One (1) Grand Prize is available. The Grand Prize consists of a Trophy plus 1) One (1) Apple iPad Air or One (1) Apple Watch Sport, 2) Entry into the championship race of the Virtual Breeders’ Cup Classic in “Blazing Silks – Breeders’ Cup Edition” “Blazing Silks – High Stakes Racing” where they will have the opportunity to win a VIP trip to the 2016 Breeders’ Cup, including travel to/from Pasadena, CA, one (1) hotel room for three (3) nights, two (2) tickets to Breeders’ Cup Friday and Saturday at Santa Anita and one (1) $100 wagering voucher. The approximate retail value (“ARV”) of the Grand Prize is $600. No cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute prize(s) of comparable value if a prize listed or any portion thereof is unavailable for any reason. Limit one (1) prize per player. “CAREER EARNINGS” ARE DENOMINATED IN DOLLARS, BUT NO PLAYER WILL BE ENTITLED TO ANY PAYMENT OF MONEY OR OTHER CONSIDERATION OTHER THAN THE PRIZES AS AWARDED IN ACCORDANCE WITH THESE OFFICIAL RULES.
GENERAL PRIZE CONDITIONS: Prizewinner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. All Prize Claim Documents and other materials submitted become the sole property of Sponsor and will not be returned. If winner fails or refuses to sign and return all Prize Claim Documents within five (5) days of prize notification (or a shorter time if required by exigencies), winner may be disqualified and an alternate winner may be selected. Prizes not claimed in accordance with these Official Rules may not be awarded.
GRAND PRIZE CONDITIONS: The Grand Prize winner must execute an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, “Prize Claim Documents”). The Grand Prize winner’s guest must be eighteen (18) years of age or older and must sign and return a liability/publicity release prior to travel. Winner and his or her guest must travel together on the same itinerary and possess all required travel documents. Air transportation tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. ARV for travel prizes may vary depending upon points of departure and destination and fare fluctuations. If the closest airport to the Grand Prize winner’s home is in close enough proximity to the prize destination city so that, as Sponsor may determine in its sole discretion, a flight is unnecessary, such prize winner will receive alternate transportation from the Sponsor with no further obligation to the winner. Grand Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the prize ARV in these Official Rules. Sponsor reserves the right to structure the travel route and select hotels in its sole discretion. In the event winner and/or his/her guest engages in behavior that (as determined by Sponsor in its sole and absolute discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send winner and/or his or her guest home with no further compensation.
Sponsor and the other Promotion Entities each make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize furnished by any Promotion Entity or third party in connection with the Contest.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR AND EACH OF THE PROMOTION ENTITIES HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
GENERAL: Acceptance of a prize constitutes prize winner’s permission for Sponsor to use prize winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Entrants agree that the Promotion Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest or any Contest-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Entrants agree that any and all disputes, claims and causes of action arising out of or connected with the Contest or any prizes awarded shall be resolved individually without resort to any form of class action. In no event will any entrant’s attorneys’ fees be recoverable. Each entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages. The Promotion Entities assume no responsibility for any damage to an entrant’s or any other person’s computer system or wireless phone which is occasioned by accessing the Website or otherwise participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, the Promotion Entities are not responsible for incomplete, illegible, misdirected, late, lost, damaged, stolen, or submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate the Contest if it determines, in its sole discretion, that the Contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Contest as contemplated herein. In the event Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) select the Grand Prize winner from the leader board from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW YORK WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
WINNER’S LIST: Any legally required winner’s list may be obtained by sending a self- addressed, stamped envelope to: The Blazing Silks Breeders’ Cup Contest Winner, Spina Technology USA, LLC, PO Box 30278, Bethesda MD 20824. All such requests must be received within six (6) weeks after the end of the Promotion Period.
